May 12 CAPE Update from CBP & CIT Orders Next Update for May 26

On May 12 US CBP provided an update on CAPE Phase 1 to the Court of International Trade, found here.
CBP’s data shows:
- 126,237 CAPE declarations submitted & 86,874 CAPE declarations passed file validations.
- 15,123,221 entries accepted for removal of IEEPA tariffs, 8,338,081 of those entries have been liquidated and/or reliquidated without the IEEPA duties.
- The anticipated duty refund on the 8,338,081 entries is $35.46 billion.
- 1,880 consolidated refunds have not been transmitted to Treasury because ACH Refund Authorization was not established for the IOR or 4811 party.
Judge Eaton has ordered CBP to provide another update on CAPE Phase 1 on May 26, 2026.
The order did mention that the CIT and CBP are discussing subsequent phases of CAPE, but no firm details on when the additional capabilities will be introduced, or what they will include.
Importers are still encouraged, for non-Phase 1 entries, to consider a protective protest prior to the 180-day post liquidation timeline to secure IEEPA refund rights.
