Yesterday, the Commerce Department’s Bureau of Industry and Security (BIS) posted 95 requests for inclusions of new tariff subheadings under the 50% Section 232 tariffs on steel and aluminum derivatives. It is important to note that comments on the inclusion requests are due in 14 days, on Oct. 21, and the postings also start a 60-day period for BIS to consider the requests. A link to the Section 232 Inclusion docket can be found here: The docket lists all of the companies that made an inclusion request and the HTS codes that they requested be included in the second round.
Yesterday’s announcement represents the second round of three periods that BIS is slated to take in 2025. With the last round of inclusion requests, it’s worth noting that out of 467 requested additional HTS subheadings, BIS accepted 407 of them and added them to the Section 232 tariffs. Those 407 HTS subheadings became effective on August 18.
We will continue to monitor this situation and provide updates, as necessary.
