USTR Seeks Comments to Extend Certain Section 301 Exclusions

Yesterday, the USTR announced that importers can seek an extension of the exclusion of 549 products that previously expired on December 31, 2020.

It’s important to note that they are not seeking comments on ALL exclusions previously granted (over 2200 products), but only the 549 products where the exclusion was extended.

The USTR is accepting comments from October 12th through December 1st on whether those Section 301 tariff exclusions that expired Dec. 31, 2020, should be renewed and, if so, for how long. Any exclusions that are eventually renewed will be retroactive only to Oct. 12, 2021.

Interested parties who wish to comment must do so through the USTR portal which can be found at https://comments.USTR.gov.

U.S. Trade Representative Katherine Tai said on October 4 that the USTR will restart a process for requesting exclusions from the Section 301 tariff on Chinese imports. The USTR didn’t provide any additional details about the process or when it might begin. Additionally, they gave no indication that the existing Section 301 tariffs would be lifted, but in fact, indicated that more tariffs could be imposed if China didn’t take sufficient actions to address U.S. concerns.
